These Terms & Conditions (“Terms”) govern all purchases, use, and access to Kobalt Tools products, services, and related content (including kobalttools.us.com and in-store interactions via exclusive partner Home Depot). By purchasing, using, or accessing Kobalt Tools (including power tools, 24-Volt MAX batteries, air compressors, and portable tool boxes), you (“User”) agree to comply with these Terms. If you do not agree, do not purchase or use Kobalt products.
1. Product Use and Safety
Kobalt Tools are designed for residential, commercial, and professional use, provided they are operated in accordance with the
user manual included with each product (or downloadable at
kobalttools.us.com). Users must:
- Follow all safety instructions (e.g., wearing protective gear when using power tools, avoiding overloading 24-Volt MAX batteries beyond their 1,000-cycle limit).
- Use only genuine Kobalt replacement parts (e.g., certified batteries, compressor filters) and accessories. Non-genuine parts may damage the product, void warranties, and pose safety risks (e.g., fire hazards with incompatible batteries).
- Avoid misuse, including but not limited to: modifying tools (e.g., altering an air compressor’s pressure valve), using tools for unapproved purposes (e.g., a portable tool box as a step stool), or neglecting maintenance (e.g., failing to drain an air compressor’s tank). Kobalt is not liable for damages or injuries caused by non-compliance with these rules.
2. Warranty Terms
Kobalt’s warranty coverage (outlined in these Terms) supersedes all prior oral/written agreements and applies only to products purchased from authorized retailers (Home Depot or
kobalttools.us.com):
- Limited Warranty: Most Kobalt products (power tools, batteries, compressors, tool boxes) carry a 3-year limited warranty against defects in materials or workmanship under normal use. Hand tools (e.g., wrenches, screwdrivers) may qualify for a lifetime limited warranty for residential use (commercial use reduces coverage to 1 year—see product packaging for details).
- Warranty Exclusions: Coverage does not apply to: (a) damage from misuse, neglect, or accidents (e.g., a dropped drill); (b) normal wear (e.g., worn tool box latches); (c) unauthorized repairs/modifications; (d) products without proof of purchase (receipt, Home Depot transaction ID).
- Warranty Claims: To file a claim, follow the process in Kobalt’s Contact Us support channels (provide model/serial numbers and proof of purchase). Kobalt reserves the right to repair, replace, or refund defective products at its discretion.
3. Limitation of Liability
To the maximum extent permitted by applicable law:
- Kobalt shall not be liable for indirect, incidental, or consequential damages arising from product use, including but not limited to: project delays, lost profits, or property damage caused by tool malfunctions (even if Kobalt was notified of such risks).
- Kobalt’s total liability for direct damages (e.g., a defective battery damaging a tool) shall not exceed the purchase price of the affected product.
- These limitations do not apply to bodily injury or death caused by Kobalt’s negligence, or to damages resulting from Kobalt’s intentional misconduct (e.g., knowing sale of defective products).
4. Intellectual Property
All Kobalt Tools trademarks (e.g., “Kobalt,” “24-Volt MAX”), logos, product designs, patents, and content (user manuals, website text) are owned by Kobalt or its licensors. Users may not:
- Reproduce, modify, or distribute Kobalt’s intellectual property without written permission.
- Use Kobalt’s trademarks to promote non-Kobalt products (e.g., labeling counterfeit batteries as “Kobalt-compatible”).
- Reverse-engineer or copy Kobalt product designs (e.g., replicating a tool box’s reinforced steel corners). Violations may result in legal action.
5. User Obligations
Users agree to:
- Provide accurate information when purchasing products (e.g., valid contact details for warranty registration).
- Comply with all applicable laws and regulations (e.g., local electrical codes when using power tools).
- Dispose of Kobalt products responsibly: Follow local guidelines for recycling lithium-ion batteries (do not incinerate) and discard damaged tools (e.g., cracked air compressor tanks) to avoid safety risks.
6. Terms Modification and Termination
- Kobalt may update these Terms at any time. Changes will be posted on kobalttools.us.com with a “Last Updated” date. Continued use of Kobalt products after changes take effect constitutes acceptance of the revised Terms.
- Kobalt may terminate access to services (e.g., warranty support) for users who violate these Terms (e.g., submitting fraudulent warranty claims).
7. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia (U.S.A.), without regard to conflict-of-law principles. Any dispute arising from these Terms (e.g., warranty disputes) shall first be resolved through good-faith negotiation with Kobalt’s support team (via 1-888-3KOBALT or
kobalttools.us.com). If unresolved, disputes may be submitted to binding arbitration in Georgia (per the American Arbitration Association rules) instead of litigation, unless prohibited by law.
8. Final Provisions
These Terms constitute the entire agreement between Kobalt and Users regarding Kobalt Tools. If any provision is deemed unenforceable, the remaining provisions shall remain in effect. For questions about these Terms, contact Kobalt’s customer support (see “Contact Us” resources for details). By choosing Kobalt Tools, you acknowledge understanding and acceptance of these Terms.
